HUSKY CORPORATION'S RETURN PROCEDURES FOR PRODUCTS SUBJECT TO HUSKY'S LIMITED-WARRANTY POLICY OR RETURNED FOR RESTOCKING

Limited-Warranty Claim Procedures:
Please login to HuskyNet.husky.com to return any product. If you do not have a HuskyNet login user ID and password, contact customer service at 800-325-3558 or sales@husky.com [link]. You will need a Return Goods Authorization (RGA) number before you can return your product(s). After logging in, click on the drop down menu to provide the following required information to get your RGA: A.) Incident type, B.) Description, and C.) Number of items being returned. Clearly mark the RGA number on the outside of all boxes and on the packing slip. This required information will help Husky Corporation efficiently process your return. You are responsible for prepaying transportation costs for delivery to Husky Corporation. Husky’s Quality Assurance Department will evaluate the returned product. If warrantable, Husky will issue credit for the original purchase price of the product to satisfy the warranty claim. If not warrantable, you will be contacted with the reason(s) that Husky disallowed the warranty. Returned products will become property of Husky and may be scrapped. If you have other warranty or product-return questions that were not answered in this paragraph, please contact customer service at 800-325-3558 or sales@husky.com.
The Limited-Warranty will NOT apply to the following: (a) Missing/unable to confirm proof of purchase; (b) Evidence of abuse, damage or use of excess force; (c) Missing parts or components; (d) Evidence of repair or rebuilt by others; or (e) Evidence of corrosion.
Return to Stock Procedures: We will always attempt to work with Distributors on returning product for credit. Before shipping back product, please obtain an RGA number using HuskyNet. Product will not be accepted without prior approval for return. Products being returned need to be current catalog merchandise, less than a year old, and resalable.
Restocking Fee: A restocking charge of twenty (20) percent of current distributor pricing will be applied to cover the normal costs of handling, testing, and inspecting returned products.

WARRANTY RETURN PROCEDURE Contact Customer Service at (800) 325-3558, via fax at (636) 825-7300, or e-mail us at sales@husky.com with the following information to receive a Return Goods Authorization (RGA) number which is required prior to every return: A) Proof of purchase. B) State problem or reason for return. C) Packing slip number of return shipment. Clearly mark the RGA number on the outside of all boxes and on the packing slip. This information is required in order for Husky Corporation to efficiently process the return. Transportation costs for delivery to Husky Corporation are to be prepaid by distributor/sender. Husky’s Quality Assurance Department will evaluate the returned product. If warrantable upon receipt, tests will be run and the method of satisfying the warranty requirements will be determined. If product is not warrantable upon receipt, the distributor will be contacted and advised of the reasons the warranty was not allowed. Husky will grant fi ve (5) business days to the sender to respond whether product should be returned. If after that time Husky receives no response, the product will be scrapped.
NOTE No warranty considerations will be given for the following conditions: A) Proof of purchase missing / unable to confirm. B) Evidence of abuse, damage or use of excess force. C) Missing parts or components. D) Evidence of repair or rebuilt by others. E) Evidence of corrosion.
RETURN TO STOCK PROCEDURES We will always attempt to work with Distributors on returning product for credit or replacement. Before shipping, notify the Customer Service Department to receive an RGA number and approval to send back unused product. Product will not be accepted without prior approval for return. Products being returned need to be current catalog merchandise, less than a year old, and resalable. Parts (ie. spouts, hand guards, waffl e splash guards) are not returnable.
NOTE Restocking charge of twenty (20) percent of current distributor pricing will be applied to cover the normal costs of handling, testing and inspection of products.
WARRANTY POLICY Husky Corporation will, at its option, repair, replace, or credit the purchase price of any BJE products, evaluated to be defective resulting from material and/or workmanship issues for a period of one (1) year. BJE Crusher housings will be covered for a lifetime from material and/or workmanship issues.
Buyer must return the products to Husky, transportation charges prepaid. The warranty excludes damages due to malfunction, failure to follow manufacturer’s installation, operation or maintenance instructions and guidelines, unauthorized modifications or alterations, abuse, or misuse.
The warranty provisions contained herein apply only to original purchasers who use the equipment for commercial or industrial purposes. There are not other warranties of merchantability, fitness for a particular purpose, or otherwise, and any other such warranties are hereby specifically disclaimed.
Husky assumes no liability for labor charges or other costs incurred by Buyer incidental to the service, adjustment, repair, return, removal or replacement of products. Husky is not responsible for any losses (including loss of profits or revenues) incurred by the purchaser during the time necessary to repair the equipment. Husky assumes no liability for any incidental, consequential, or other damages under any warranty, express or implied, and all such liability is hereby expressly excluded.
Husky reserves the right to change or improve the design of any Husky Oil Filter Crushers, Tank Alarms, Tank Gauges, Overfill Alarms, Overfill Accessories, Air Shut-off Valves, Solenoid Valves, and Electronic Drain Valves without assuming any obligations to modify any Husky Oil Filter Crushers, Tank Alarms, Tank Gauges, Overfill Alarms, Overfill Accessories, Air Shut-off Valves, Solenoid Valves, and Electronic Drain Valves previously manufactured.
Items repaired by Husky Corporation will have a 90-day warranty from date of repair.

LIMITED WARRANTY & DISCLAIMER: Except with respect to goods (or components thereof) manufactured by others, Husky (the seller), warrants, for a period of one (1) year following shipment, only that the goods and/or services described herein (the “goods”) are free from defects in workmanship performed by the seller that exist at the time of shipment of the goods by the seller. All warranty claims must be made within one (1) year after the seller has shipped the product. The seller’s liability hereunder is limited to the purchase price of any product proven defective or, at the seller’s option, to the replacement of such product F.O.B. the seller’s home office.
It is understood and agreed that the seller’s liability and purchaser’s sole remedy, whether in contract, under any warranty. In tort (including negligence), in strict liability or otherwise shall not exceed the return of the purchase price paid by purchaser, and under no circumstances shall seller be liable for any special, incidental or consequential damages, including, but not limited to, personal injury, property damage, damage to or loss of equipment, lost profits or revenue, cost of renting any replacement or any other additional expenses, even if seller has been advised of the possibility of such damages. The price stated for the equipment is a consideration in so limiting seller’s liability and purchaser’s remedy. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. The law of the State of Missouri shall apply to any resulting agreement with respect to a sale of the goods.
Seller will not be liable for any damages, losses or expenses as a result of the negligence of the purchaser or any user, whether deemed active or passive and whether or not any such negligence is the sole case of any such damage, loss or expense.
This warranty is in lieu of and excludes all other warranties, expressed, implied, statutory or otherwise created under applicable law. Including, but not limited to, the warranty of merchantability and the warranty of fitness for a particular purpose. In no event shall the company be liable for special, incidental or consequential damages, including loss of profits.
As to goods (or components thereof) sold by the seller but manufactured by others, the buyer shall accept in lieu of any liability, guarantee, or warranty from the company, the benefits of any guarantee or warranty obtained by the seller from the manufacturer thereof. This information is furnished solely to notify the buyer that they may be covered by a warranty from the manufacturer. The seller is not adopting or assuming responsibility for the manufacturer’s warranty, and is not making any other expressed or implied warranty including, but not limited to, warranties of fitness for a particular purpose or of merchantability concerning these goods.
